How do I go through bank statements for divorce financial disclosure?
Gather 12 months of statements for every account in your name (often more in US cases), convert them to a spreadsheet, and use it to total your income and spending and to list large or unusual transactions. Submit the original statements; the spreadsheet is your working.
In England and Wales, Form E asks for the last 12 months of statements for each bank account. US states use a financial affidavit or disclosure statement, and discovery requests often reach back further. Either way you're facing a stack of statements and a deadline.
The statements themselves go to your solicitor or attorney as they are. The work is everything you have to work out *from* them: your average monthly income, what you spend and on what, and which large transfers you'll be asked to explain. That part is far quicker in a spreadsheet than flicking through PDFs.
Step by step
- List every account: current, savings, credit cards, joint accounts and any you closed during the period.
- Download 12 months of statements for each, or the period your solicitor or attorney gives you.
- Convert them to Excel with the batch converter. Check the opening and closing balances match each statement.
- Put each account on its own sheet, then add a column for your own categories: income, housing, bills, food, children, transport and so on.
- Total income and each spending category per month. These feed the income and expenditure sections of Form E or the expense columns of a financial affidavit.
- Filter for large or unusual transactions and note what each one was, before anyone asks.
Things that are easy to miss
- Transfers between your own accounts look like spending on one statement and income on the other. Mark them so they don't count twice.
- Accounts closed during the period still need disclosing.
- Cash withdrawals add up. Total them per month; you may be asked what they were for.
- Your spouse's statements come through their own disclosure. Reconcile joint accounts against what they provide.
